Welcome to Akina Immigration and Citizenship Practice ("Akina Immigration," "we," "our," or "us").
These Terms and Conditions govern your use of our website and the immigration consulting services we provide.

By accessing this website, booking a consultation, purchasing services, making a payment, or retaining our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use our website or services.

About Akina Immigration

Akina Immigration and Citizenship Practice is a privately owned Canadian immigration consulting practice. We are not affiliated with, endorsed by, or acting on behalf of the Government of Canada, Immigration, Refugees and Citizenship Canada (IRCC), the Canada Border Services Agency (CBSA), or any other government department or agency.
Our immigration consulting services are provided by Rufaro Munyurwa, Regulated Canadian Immigration Consultant (RCIC #R531627), who is licensed by the College of Immigration and Citizenship Consultants (CICC).

Government Immigration Services
Â
Many Canadian immigration applications, permits, visas, permanent residence applications and citizenship applications may be completed and submitted directly by applicants through Immigration, Refugees and Citizenship Canada (IRCC) without hiring a paid representative.
Official Government of Canada immigration information and application forms are available at www.canada.ca.

Clients who choose to retain Akina Immigration are engaging us to provide professional immigration advice, application preparation, representation and communication with the appropriate authorities on their behalf.
Â
Eligibility to Use Our Services
Â
By using our website or retaining our services, you confirm that:

you are at least 18 years of age or have the consent of a parent or legal guardian;

the information you provide is true, complete and accurate;
-
you have the legal authority to enter into a binding agreement; and
-
you will comply with all applicable laws and regulations.

Professional Services
Â
The information provided on this website is for general informational purposes only and does not constitute legal advice or create a consultant-client relationship.
Â
A consultant-client relationship is established only after:

-
a signed Retainer Agreement has been executed by both parties; and
-
any required retainer or initial payment has been received.
The scope of services for each client is governed exclusively by the applicable Retainer Agreement.

No Guarantee of Approval
Â
Akina Immigration provides professional immigration consulting services based on current Canadian immigration legislation, regulations and published policies.
Â
We cannot and do not guarantee:
Â

approval of any immigration application;
-
issuance of any visa, permit or travel document;
-
approval of permanent residence or citizenship;
-
processing times;
-
requests for additional documentation; or
-
any particular immigration outcome.
Â
All immigration decisions are made solely by the appropriate government authority, including but not limited to Immigration, Refugees and Citizenship Canada (IRCC), the Canada Border Services Agency (CBSA), the Immigration and Refugee Board of Canada (IRB), provincial governments, or foreign government authorities where applicable.
Professional fees compensate us for our knowledge, time and professional services and are not contingent upon a successful outcome.

Client Responsibilities
Â
Clients agree to:

provide complete, truthful and accurate information;
-
promptly provide all requested documentation;
-
advise us immediately of any changes to their personal circumstances, immigration status, employment, marital status or contact information;
-
carefully review all applications before submission;
-
respond promptly to requests for information; and
-
cooperate throughout the immigration process.
Â
Providing false, misleading or incomplete information may result in termination of our services and may negatively affect an immigration application.
Â
Fees and Payment
Â
Professional fees are outlined in each client's signed Retainer Agreement.
Â
Unless otherwise stated in writing, government filing fees, biometrics fees, medical examination fees, translation fees, courier costs, educational credential assessments, language testing fees and other third-party costs are separate from our professional fees and remain the responsibility of the client.
Payment is due in accordance with the payment schedule contained in the applicable Retainer Agreement.

We reserve the right to suspend work on a file where required payments remain outstanding.
Â
Payment Processing
Â
Payments made through our website are processed securely by third-party payment processors.
Â
By providing payment information, you represent that:

you are authorized to use the payment method provided;
-
all payment information is accurate; and
-
you authorize the applicable payment processor to charge the agreed amount.
Â
We do not store complete credit card information on our servers.
Â
Refund Policy
Â
Refund requests are assessed on a case-by-case basis in accordance with the signed Retainer Agreement.
Â
Professional fees compensate Akina Immigration for professional services rendered and time spent on a client's matter.
Â
Accordingly:
-
consultation fees are non-refundable once the consultation has taken place;
-
fees for completed work are non-refundable;
-
if services are terminated before completion, any refund will be determined after deducting the value of services already performed;
-
government processing fees, biometrics fees and third-party expenses are generally non-refundable once incurred or submitted; and
-
no refund will be provided solely because an immigration application is refused, delayed or subject to additional review by a government authority.

Approved refunds will generally be processed within fourteen (14) business days using the original payment method whenever possible. Refund requests must be submitted in writing to info@akinaimmigration.com and will be reviewed in accordance with the applicable Retainer Agreement.

Cancellation Policy
Â
Clients may cancel services by providing written notice.
Â
If work has already commenced, Akina Immigration may retain fees for services already completed and any expenses incurred on the client's behalf.
Â
Outstanding fees for completed work remain payable.
Â
Akina Immigration may withdraw from representation where permitted by applicable law, the CICC Code of Professional Conduct or the applicable Retainer Agreement.
Â
Confidentiality and Privacy
Â
We are committed to protecting the confidentiality of our clients' information.
Â
Information provided to us will be collected, used, stored and disclosed only:

to provide immigration consulting services;
-
with the client's authorization;
-
where required by law;
-
in accordance with our Privacy Policy; or
-
as required by regulatory authorities governing immigration consultants.

Intellectual Property
Â
All content contained on this website, including text, graphics, logos, images, forms and other materials, is the property of Akina Immigration and Citizenship Practice unless otherwise stated.
Â
No content may be copied, reproduced, distributed or used without our prior written consent.
Â
Third-Party Websites
Â
Our website may contain links to third-party websites for your convenience.
Â
We are not responsible for the content, privacy practices or accuracy of any third-party website and do not endorse any products or services offered through those websites.
Sanctions Compliance

Akina Immigration complies with all applicable Canadian laws relating to sanctions, export controls and anti-money laundering.

We do not provide services to individuals, organizations or entities where doing so would violate applicable Canadian laws or sanctions.
By engaging our services, you represent that you are not subject to any applicable Canadian sanctions or restrictions that would prohibit us from providing services to you.
We reserve the right to decline or terminate services where necessary to comply with applicable laws or regulatory requirements.

Limitation of Liability

To the fullest extent permitted by law, Akina Immigration shall not be liable for any indirect, incidental, consequential or special damages arising from the use of our website or professional services. Our liability, if any, shall not exceed the amount of professional fees actually paid to us for the services giving rise to the claim.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable law.

Termination
Â
We reserve the right to suspend or terminate access to our website or professional services where:

these Terms and Conditions are breached;
-
payment obligations are not met;
-
false or misleading information has been provided;
-
continued representation would violate applicable law or professional obligations; or
-
termination is otherwise permitted under the applicable Retainer Agreement or the CICC Code of Professional Conduct.
Â
Termination does not relieve either party of any outstanding obligations accrued before termination.
Â
Governing Law
Â
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Â
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.
Changes to These Terms
Â
We reserve the right to amend these Terms and Conditions at any time.
Â
Updated versions will be posted on this website with a revised "Last Updated" date.
Â
Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
